The California Firearm Bill of Sale is a legal document to show that a purchase of a firearm has taken place between a seller and a buyer. This document is required to be signed by 2 witnesses and all signatures are to be witnessed by a notary.

Registering a Firearm in California

Unlike some states, the state of California has relatively stringent rules and regulations with regard to gun ownership transfers, certification for use and documentation. The state takes extraordinary measures to ensure that, what they feel are the rights of the people, with regard to firearm ownership are protected, yet they also want to protect the rights of safety for all of their state citizens as well as those who visit the state. Therefore, firearms must be registered in the state of California and that transfer of ownership information, must be conducted through a licensed firearm dealer. The state requires that their owners are able to prove that they know how to use the firearms through certification and testing. The following information will be required in order to be a legal gun owner in California:

  • You must be 21 years of age and possess a current state ID and/or Driver’s license
  • If you are a resident alien with a permanent resident alien status within the U.S., you will be required to have an ID card or an I-94 #. As well, you will be required to have a valid California ID or driver’s license. If you are here on an I-94 visa, you will be required to have a valid United States hunting license, an a Visa with 90 days Consecutive proof of residency.
  • You will be required to be in possession of a handgun safety certificate, also known as an HSC
  • OR
  • You will need to have proof of an HSC exemption
  • The HSC is a 30 question, true/false, multiple choice test. You may miss 7 out of 30 and still receive a passing grade. The HSC is good for 5 years at a time.
  • You will be required to have proof of a secondary residency and again 90 days of consecutive residency for resident aliens as well as 90 consecutive days of utility bills with the potential owner’s name and current ID or License address
  • A copy of a residential lease or proof of mortgage will be required
  • $25.00 fee
  • It’s important to know that (according to Pen. Code, § 27545)  you must purchase and/or register your firearm through a registered dealer. There are some exemptions ie: if you’re a collector buying or selling guns that are 50 years old or older, you will not require registration.
  • These are the things that will be needed in order to register and legally posses a firearm in the state of California. The rules and regulations vary also from city to city.

Once you’ve collected all of your documentation it must be delivered to a licensed firearm dealer with the firearm. You must then wait 10 days or 10, 24 hour periods before you may pick up your firearm. The Department of Justice (DOJ) will retain all of your information with regard to your firearm.

How To Write

Step 1 – Buyer and Seller Information –  Download the document and enter all of the following information:

  • The Seller – 
  • Name
  • Driver’s License Number
  • Physical Address
  • City
  • State
  • AND
  • The Buyer – 
  • Name
  • Driver’s License Number
  • Physical Address
  • City
  • State

Step 2 – Firearm Details – Enter the following information with regard to the details of the firearm into the lines provided:

  • Make
  • Type/Model
  • Caliber
  • Serial Number (SN)

Step 3 – Trade/Purchase Price – Check the appropriate box and complete the information required, from the following:

  • Seller accepts monetary funds in the amount of :(Enter the price in word description)
  • Dollars  (Enter the number dollar description in the line provided)
  • To be paid on (date negotiated to purchase the firearm)
  • The date of this bill of sale known as (enter the date that the sale date will be known as in mm/dd/yyyy format)
  • At a future date no later than (enter the final accepted date for payment to be made)
  • Other (If different negotiations have been arranged, place the description of such negotiations on the line of the form
  • Seller accepts trade for the firearm described as (If a trade has been negotiated, as opposed to monetary payment, describe the trade on the line provided)

Step 4 – Buyer’s Disclosure: The buyer must read all of the information in this section in it’s entirety. If the buyer agrees, before 2 witnesses and a notary, they must then provide signature in agreement

Step 5 – Seller’s Disclosure – The Seller, must read the statements in this section. If the seller agrees, before 2 witnesses and a notary, the seller must provide signature in agreement

Step 6 – Signatures – In this area seller, buyer witnesses and then the notary will all provide signatures as follows:

  • Date the document in dd/mm/yyyy format and read the remainder of the statement – Provide the following:
  • The Seller – 
  • Signature
  • Printed Name
  • The Buyer
  • Signature
  • Printed Name
  • Witness 1 – 
  • Signature
  • Printed Name
  • Witness 2 – 
  • Signature
  • Printed Name

Step 7 – Notarization – Once the notary has witnessed all signatures, they will complete the remainder of the form and affix their state seal.

Once the form is completed, witnessed and notarized, make copies for all who have provided signature for record keeping, give the original document to the the buyer or recipient of the firearm, by purchase or trade and agreement.
