Florida Firearm Bill of Sale Form

The Florida Firearm Bill of Sale is a legal document that is used to prove that a firearm in the state of Florida has been sold, purchased or traded and is changing ownership. This document will require notarization, therefore all signatures should be withheld until all parties are before a notary public, have been identified and witnessed.

Register a Firearm in Florida

The state of Florida does not have any gun registration laws and does not require gun licensing.

Where to Register – There is not registration needed in the state of Florida

Needed to Register – Unless you have either adjudicated delinquent or had adjudication withheld for a felony as a juvenile until that person reaches 24; and bars the purchase of firearms by anyone who has had adjudication withheld for any felony or a misdemeanor crime of domestic violence and three years has not yet lapsed since the completion of sentencing provisions.
If you are a Florida Resident, as long as you are able to, truthfully, answer the questions on the first page of ATF 4473 form, do not fall under the delinquency or adjudication withheld provisions discussed above, and are not disqualified by the answers to those questions, and have an acceptable form of ID, you may purchase or own a firearm in the state of Florida. If you are over the age of 18 you may own a rifle or a shotgun. If you are over the age of 21 you may purchase and own a handgun, as long as the firearm itself is not restricted ie: a sawed off shotgun or any machine gun.  Florida does impose a 3 business day ‘cooling off period’ for the purchase of a handgun. Should you decide to purchase a handgun from a licensed dealer, in most circumstances you will be unable to collect the firearm until the third business day (this does not count Saturdays, Sundays and most Holidays) after the  purchase. This is not including the day of the purchase. There are exceptions to this for those who have a Florida State Concealed Weapons license. In this case they are not subject to a waiting period.  In addition, a few counties will have a mandatory five day waiting period. Broward County and Palm Beach County would be two of those counties.

How To Write

Step 1 – Seller and Buyer Information – Both parties must enter the following information:

  • The Seller –
  • Name
  • Driver’s License Number
  • Physical Address
  • City
  • State
  • AND
  • The Buyer –
  • Name
  • Driver’s License Number
  • Physical Address
  • City
  • State

Step 2 – Firearm Details – Enter the details of the firearm being sold and purchased:

  • Make
  • Type/Model
  • Caliber
  • Serial Number (SN) (If applicable)

Step 3 – Trade/Purchase Price – Check the boxes that apply to this transaction. Offer additional information if required:

  • If the first box is checked, the seller is accepting monetary payment – Enter the dollar amount in words
  • Enter the dollar amount in numbers
  • Specify the agreed date when payment will be made mm/dd/yyyy format
  • Enter the date in which the document will be known as in mm/dd/yyyy format
  • If the parties have agreed that payment will be made at a later date, enter the date in mm/dd/yyyy format
  • Other – If different negotiations have been agreed upon by the parties, enter a brief description of the negotiations (if extra room is required add a sheet and attach it to the form
  • Check the box if no money will be exchanged if the item(s) are being provided as a gift to the “buyer”
  • The last box in this section will address a direct trade. Enter a brief statement of the conditions of the trade in the lines provided

Step 4 – Buyer’s Disclosure –

  • The buyer must read all of the statements in this section. If in agreement, in the presence of a notary, the buyer should provide signature

Step 5 – Seller’s Disclosure –

  • The seller must review all of the statements in this section. If in agreement, the seller, in the presence of a notary public, must provide signature

Step 6 – Signatures – In the presence of a notary, date the signatures in dd/mm/yyyy format, then provide the following:

  • The Seller –
  • Signature
  • Printed Name
  • AND
  • The Buyer –
  • Signature
  • Printed Name
  • AND
  • Witness 1 – 
  • Signature
  • Printed Name
  • AND
  • Witness 2 – 
  • Signature
  • Printed Name

Step 7 – Once the notary public has witnessed all signatures, the notary will complete the remainder of the form.

  • Make copies of the form to provide to all of the signing parties a copy for record keeping
  • Give the original copy to the buyer
