The New Mexico Firearm Bill of Sale is a legal document in which a seller and buyer may prove that a legal sale of a firearm has been transacted. This document will provide information with regard to the seller, buyer and prove change of ownership for the protection of both parties. This form will also provide identifying information with regard to the firearm. It is recommended that this form be notarized for the privacy and protection of both the seller and the buyer.

Register a Firearm in New Mexico

The state of New Mexico practices very lenient firearm laws. The only law that is implemented and enforced in New Mexico with regard to carrying a firearm is one in which one would choose to carry a concealed weapon. Firearm restrictions in the state are minimal at best.

Where to Register – There is no registration for handguns, pistols, rifles or shotguns in the state of New Mexico

  • No permit is necessary to purchase rifles, shotguns, handguns or pistols
  • there is no permit required under concealed carry laws to carry a rifle or shotgun
  • License of ownership is not necessary

Needed to Register – Since there is no registration required there will be little if any documentation past a bill of sale for the protection and record keeping of the seller and buyer. However, if you do not have a current concealed carry license in one of many states, you will have to acquire one if you wish to carry concealed.

Under New Mexico concealed carry laws, a permit is necessary to conceal a handgun or pistol.

According to concealed carry laws, New Mexico is considered a “shall issue” state and protects the rights of it’s citizens to carry concealed handguns. An applicant must be at least 21 years of age. Any applicant for a concealed carry permit must provide proper documentation which will detail state residency in New Mexico. Concealed carry laws will require an applicant to complete a NM state approved training course. This shall include at least 15 hours of on site class time. Instructional classes and shooting training will vary based upon the type of weapon and caliber. Unlike most states, New Mexico does, in fact, require that the license holder pass a shooting proficiency test every two years. The complete process to acquire a license to carry concealed weapons takes approximately 3 months but then the license shall be valid for 4 years.

How to Write

Step 1 – Seller and Buyer Information – The parties must provide the following information on the form :

  • The Seller –
  • Name
  • Driver’s License Number
  • Physical Address
  • City
  • State
  • AND
  • The Buyer –
  • Name
  • Driver’s License Number
  • Physical Address
  • City
  • State

Step 2 – Firearm Details – Enter the information regarding the firearm as requested on the form:

  • Make
  • Type/Model
  • Caliber
  • Serial Number

Step 3 – Trade/Purchase Price – Select any of the applicable boxes:

  • If the first box is checked, the seller will only accept monetary payment – Enter the worded dollar amount
  • Enter the dollar amount in numbers
  • Provide a specific date as to when the parties have agreed that payment will be due, in mm/dd/yyyy format
  • Specify a date in which the form will be known as, in mm/dd/yyyy format
  • Should the parties agree to make payment due at a later date, enter the date, in mm/dd/yyyy format
  • Other – If the parties have decided on other terms to this agreement, disclose the terms
  • Check the box if the firearm is intended as a gift
  • Check the box if this is intended to be a direct trade, then provide a brief description of the terms of the agreement regarding the trade

Step 4 – Buyer’s Disclosure – The seller must carefully review all statements and disclose any known defects. Once the defects have been disclosed, the seller may provide signature in the “buyers signature” space provided. .

Step 5 –  Signatures – Provide the following:

  • Date the signatures in dd/mm/yyyy format at the top of this section
  • The Seller –
  • Signature
  • Printed Name
  • AND
  • The Buyer –
  • Signature
  • Printed Name
  • AND
  • Witness 1 – 
  • Signature
  • Printed Name
  • Witness 2 –
  • Signature
  • Printed Name

Step 7 –  Notarization – When the notary public has had the opportunity to witness all signatures, then she/he will complete the document with the required information and by authenticating the document by affixing the state seal

  • Make copies of the completed document for the signatories
  • Give the original copy to the buyer
