The Georgia quit claim deed is a document used to convey property from a seller to a buyer. It is fair to note, this type of deed transfers ownership with no guarantee. The seller, in this case, is merely transferring whatever interest he or she has in the property. That interest could be a full, unrestricted interest, or it could be no interest or something in between. It is important that a buyer (also known as the “grantee”) complete a thorough search of the land records in any transfer, even those with a guarantee, so the buyer knows exactly what he or she is purchasing and whether or not there are easements, restrictions or other title issues.
Recording – To be filed with the in the jurisdiction of the property.
Signing ( & ) – Must be signed with the Grantor(s) being in the presence of a Notary Public and Two (2) Witnesses (only One (1) Witness if the Notary Public agrees to also be a Witness).
How to Write
Step 1 – You may secure a blank copy of the Georgia Quit Claim Deed for your use by selecting one of the buttons below the image to the right of these instructions. Three file types are available and each button is labeled accordingly “PDF,” “ODT,” and “Word.” Once you have made the appropriate selection for your system, save it to your computer then open it to fill in the required information.
Step 2 – Locate the phrase “Prepared By,” then fill in the Full Name of this document’s Preparer. This is the individual who supplies information on the blank spaces in this form. Below, use the blank spaces (labeled “Address,” “State,” and “Zip Code”) to enter the Street Address, State, and Zip Code where the Preparer is located. Make sure to place each component of this Address on the appropriately labeled space.
Step 3 – Now, you must indicate where the Georgia Clerk of County should return filed materials. This information should consist of the Name of an approved Mail Recipient and the Mailing Address of the approved Mail Recipient. There will be a separate blank line designated for the “Name,” “Address,” “State,” and “City, State & Zip Code.”
Step 4 – The County where the Property of interest is located will need to be documented on the blank space below the heading “State of Georgia.”
Step 5 – Locate the phrase “in consideration of the sum of,” then document the full dollar amount the Payee will give the Grantor in exchange for the Grantor’s claim or interest in the Property defined on this form. This dollar amount must be written out on the first space and entered numerically on the second space.
Step 6 – Locate the exact phrase “…conveys and forever quit claims to” then report the Full Name of the Grantor. This is the individual who will receive the Payment above in exchange for his or her Claim to the Property. On the next blank line following where you entered this Name, write “Grantee” to define this party.
Step 7 – The following blank space (noted by the phrase “residing at”) will need the Complete Address of Residence the Grantor maintains. Following this will be three blank areas where you may report the “County of,” “City of,” and “State of” the Address of Residence the Grantor maintains.
Step 8 – The Grantee will now be defined. This will be the party who will receive the Grantor’s claim or interest as a result of this form’s signing. Enter this party’s Name on the blank space following the phrase “…hereby conveys and forever quitclaims to.” Then, write in the word “Grantee,” on the next available space, to solidify this party’s title.
Step 9 – The next four blank spaces are designated areas to fully report the Address where the Grantee resides. In the first one after the phrase “residing at,” enter the Grantee’s Street Address. The following spaces “County of,” “City of,” and “State of” will necessitate the County, City, and State where the Grantee resides.
Step 10 – Locate the blank line immediately after the phrase “described real estate, situated in,” and enter the County where the Property being defined is located. The area below this line will contain several blank lines where a Legal Description of the Property must be supplied. This should consist of the Legal Description of the Property in question as it appears on the books in the State of Georgia.
Step 11 – The top of the second page is reserved for the Grantors of the defined Property. You may add additional Grantor’s by copying and pasting one of the columns below the existing ones. The first line of one column will be where the Grantor must Sign his or her Name (above the words “Grantor’s Signature”). On the blank line above the words “Grantor’s Name,” the Signature Party must Print his or her Full Name. The next two lines, “Address” and “City, State & Zip,” must have the Full Address of the Grantor reported.
Step 12 – The Georgia Clerk of County will not accept a Georgia Quit Claim Deed, unless it has been Signed, Witnessed, and Notarized. The area “In Witness Whereof” is provided toward this end. The individual(s) witnessing this signing must Sign his or her Name on the Witness’s Signature line. Then on the Witness’s Name line, the Signature Party must print his or her Name. As with the Grantor Signature area, there will two blank lines, “Address” and “City, State & Zip” provided so the party Witnessing the Grantor Signature may report his or her Address.
Step 13 – The final area is also a required area. This document must be Notarized by a Notary Public here. The Notary Public will supply all the information required under second page heading “State of Georgia).” This may only be done at the time of Signing and should include the County, present Parties, Date, Notary Public Number, Commission Expiration, and Notary Seal.
Step 14 – The completed form will need to be submitted to the Georgia Clerk of County responsible for the district where the Property is located. Each County will have its own requirements and there may be additional requirements depending upon your circumstances. Contact the appropriate Georgia County Clerk to find out that County’s Fees and Transfer Taxes that must be submitted with this filing.
