The Florida unsecured promissory note is used for transactions that involve the loaning of money between two parties. The agreement helps ensure the lender receives his or her interest revenue as well as be reimbursed for the full balance. Both the lender and borrower need to agree on the various sections of the agreement before it can go into effect. Because the this note is unsecured, it does not guarantee the lender reimbursement if the borrower defaults on the balance. Because of this, the lender should lend to those that can be full trusted.

How to Write

Step 1 – Both the lender and borrower need to enter their full names as well as their addresses at the top of the page. Then, the full balance of the loan as well as the interest rate selected need to be entered into the document.

Step 2 – In section one (1), determine how the balance will be paid back to the lender. Options range from:

  • No Installments
  • Installments
  • Interest Only Payments

If you determine an option utilizing installments is right for both parties, select either weekly or monthly payments on the bottom of the first section.

Step 3 – For the second (2) section, enter the final due date for the entire balance. This includes any late fees and/or accrued interest.

Step 4 – Heading to the third (3) section, enter the amount of interest that will be put into effect in the case of a default or if the borrower does not make an installment within fifteen (15) days of its due date. To ensure you have selected a legal interest rate, check Ch. 687.03 and Ch. 687.071. to see Florida’s legal requirement for interest rates.

Step 5 – For sections six (6) and seven (7), enter the amount of days that need to pass before a late fee can be issued. Then, enter the monetary cost of a late fee itself. For the seventh section, enter the time span required in regards to acceleration.

Step 6 – To complete the agreement and put it into effect, write the current date on the last page followed by the signatures of the lender, borrower, and witness to the completion of the agreement.
