The Minnesota Standard Residential Lease Agreement Form is a legal written contract whose sole purpose is to bind a Lessor and a Lessee to the terms and conditions contained within. This done by means of having each party sign this document as of a certain date. Several aspects to such a contract will have to be fully discussed between these two parties before entering this lease.
There are many benefits to having a written agreement and, in some cases, a written agreement is required by law (i.e. Minnesota Statutes Chapter 504B.111). In many cases, having a written contract representing a lease is simply the wisest course of action for those entering it. This will protect the original agreement as is over a long period of time from any misunderstandings or unpleasant surprises. Both Lessor and Lessee may enjoy the fact that any expectations the lease provides them will be fulfilled. If not, a slighted party may use the court system to compel a violating party to living up to his/her obligations.
How to Write
Step 1 – Locate the number “2” in the left margin (beside the word “Tenants”). On lines 2 and 3 enter the full name of each adult who will be signing this lease and should be a considered a Lessee or Tenant in this contract.
Step 2 – On line 4, enter the full name of anyone who will be living with the Tenants but not to be considered part of the lease.
Step 3 – On line 6, enter the full name of the Landlord of the property being leased.
Step 4 – Line 8 will have three blank lines to define the leased property. Enter the Street Address, City, and Zip Code of this property in the appropriately labeled spaces.
Step 5 – On line 10, define how long the lease is. Do this by entering the number of months from the start date of the lease to the end date of the lease. Note if this is a Month-to-Month with no end date then simply write the words “Month to Month.”
Step 6 – On line 11, next to “Starting Date of Possession,” enter the start date of the lease. Then next to the words “Ending Date of Possession,” enter the end date of this agreement (unless it is a month to month agreement).
Step 7 –Line 12 will have two blank lines. In the first blank space, enter the rent amount the tenant must pay each month. Then on the second line, enter the security deposit amount the landlord requires for holding.
Step 8 – On line 13, enter the penalty amount a tenant must pay should they not pay the full rent amount by the due date.
Step 9 – Line 14 will allow for any other charges that a tenant must pay (i.e. for bounced checks submitted as payment.
Step 10 – Line 15 to Line 25 will feature a table which will act as a receipt for the Tenant from the Landlord. There will be an amount column which must be filled in for the following items: First Month’s Rent Paid in Advance, First Month’s Utilities Paid in Advance, Last Month’s Rent Paid in Advance, Security Deposit Paid in Advance, First Month’s Rent for Garage Paid in Advance, First Month’s Rent for Storage Unit Paid in Advance, and Other (for any items not mentioned the tenant has submitted a payment for). Once all these items have had a dollar amount assigned, this dollar amount must be totaled in the last box of the “Amount Column.”
Step 11 – Lines 29 through 55 is a table assigning responsibility for utility/service bills. The columns will define how the bill will be paid by placing a check mark in the appropriate column for that utility/service bill. There are several choices to choose from for each bill: Landlord Pays Service Provider, Tenant Pays Directly to Service Provider, Tenant Pays the Landlord, and Tenant Pays Landlord for Portions of Utilities or Services. Place a check mark in only one of these columns for each utility and or service.
Step 12 – On lines 56 through 61 will contain a list of appliances. For each appliance the Landlord has provided the Tenant by virtue of the rental arrangement, place a check mark in the blank space next to that appliance.
Step 13 – On line 63, enter the name of the property manager (or authorized agent of the property owner).
Step 14 – On line 64 and 65, use the available blank spaces to report the Street Address, City, State, Zip Code and Telephone Number of the property owner’s authorized agent or property manager.
Step 15 – On line 67, report the name of the individual who the property owner has authorized to receive or issue notices on behalf of the landlord.
Step 16 – On line 68 and 69 report the Address, City, State, Zip Code, and Telephone number of the individual named on the previous line (line 67).
Step 17 – Lines 71 through 74, describe or report any additional agreements the Lessor and Lessee have reached that should be considered a part of this lease and bound by this lease.
Step 18 – On line 81, or Item 2 (Rent), report the address the Tenant must submit his/her rent payments to as per the property owner’s instructions.
Step 19 – Items 3 through 31 are the terms and conditions of this lease. These sections should be read carefully and understood by all the signature parties of this lease.
Step 20 – Lines 245 through 261 are reserved for lead paint disclosures. In section A, enter the address of the premises (if applicable). In section B, enter the name the records and/or reports the Landlord has supplied the Tenant
Step 21 – Line 266 is reserved for the Tenant’s initials should he/she have been given the pamphlet titled “Protect Your Family from Lead in Your Home.”
Step 22 – On line 271, the attending Agent must also provide his/her initials to verify they have complied with their responsibilities in regard to 42 U.S.C. 4852(d).
Step 23 – On line 275, the Landlord, Tenant, and Agent must supply their initials and the date of their initials to verify that section 32 is true and accurate.
Step 24 – Lines 296 through 299 are reserved for the formula used to calculate a Tenant’s utility bill if the column labeled “Choice 4” in the table described in Step 11 (lines 29-55) has been selected for any utilities. If so, the Landlord must provide the past bills for the previous year for any utility or service where choice 4 is the method of payment. On line 303, enter the year from the utility bills furnished. Then fill out the table with total amount on that bill each month for the applicable utilities on lines 306 through 318. Line 319/320 will require the monthly average for that utility/service of that year to be reported. If the Tenant and Landlord agree to using the monthly average as the amount due, they must each provide his/her initials in acknowledgement of this on line 325.
Step 25 – Any additional provisions the signature parties have agreed to fulfill as part of this agreement should be documented under the heading “Additional Terms” on lines 342 through 359.
Step 26 – The final part of this document will require the signature and signature date of each participating Landlord in the “Landlord” column. Then in the column labeled “Tenants,” each participating Tenant must sign his/her name and date the signature.
Step 27 – In the box labeled “Receipt by Tenants,” each Tenant may sign and date his/her name as verification they have received a signed original or copy of the lease. Below this will a Move-In Inspection and Move-Out Inspection checklist for the premises. Each row must have the condition the object described in the first column entered in the second column. The third column will be reserved for any comments to be made. The bottom of each checklist will contain an area for each Landlord and each Tenant to sign upon its completion.
