The New Jersey Association of Realtors Lease Agreement is a considered a legal contract between a landlord and lessee for the rental of residential property for a length of time as stated and agreed in the contract between the two parties. The contract will assist the landlord in locating and acquiring a tenant who will satisfy all of their needs for a desirable tenant for their property, such as one with a history of cleanliness and care for the property as well as timely reliance of rental payments. The same should be provided, in exchange, for the lessee, regarding properly operational appliances, plumbing and electrical operations, overall proper rental repairs as and when needed, among others.

Although the application is lengthy, the lessee should take the time to review the entire document to the best of their ability in order to protect their own interest. The landlord should also do their due diligence to ensure that all information that has been provided, is accurate and will provide the quality of tenant for whom they’re searching. If the prospective tenant, at any point is experiencing difficulty understanding their rights, the tenant may wish to take the document to a qualified attorney for clarification.

How To Write

Step 1 – Residential Lease Agreement – Enter the Landlord’s Information as follows:

  • Landlord’s Name
  • Landlord’s Complete Address
  • AND
  • Tenant’s Full Legal Name (All tenants who will occupy the property)
  • Tenant’s Current Complete Address

Step 2 – The tenant(s) must review the information located in section 1. “Condominium/Co-Operative Right of Termination”

Step 3 – Property – Tenant must read the brief statement and complete the fields as follows:

  • Apartment Number
  • OR
  • Condominium Unit Number
  • OR
  • Townhouse Unit Number
  • AND
  • Street Address
  • City (New Jersey)

Step 4 – Term – Tenant must review the paragraph and then place the term of the lease information into the blank fields provided:

  • Enter the number of months the lease will last
  • Enter the date in which the lease shall commence
  • Enter the date in which the lease shall end

Step 5 – Rent – Tenant must review the information with regard to the amount and frequency of payment of rent to be certain that it’s been entered properly by the landlord. Review all of the following fields:

  • The rental amount for the term of the lease
  • The rental amount will be paid (usually monthly)
  • The date of each month the rent is due
  • The rent shall be payable to the name and complete address as provided on the contract, generally the name of the landlord at the beginning of the contract.

Step 6 – Initial Deposit – Provide all information regarding the deposit as follows:

  • Initial amount of deposit paid by tenant
  • Date received
  • Select what the deposit will be credited toward and the landlord check the appropriate line
  • Complete the fields reflecting the balance due (if any)
  • Tenant and Landlord must initial in agreement in the lower right side of the page

Step 7 – Security Deposit – The tenant, for their own protection, must read the entire section with regard to the security deposit being provided to the landlord –

  • In the field provided, enter the sum of the security deposit

Step 8 – Late Payment Penalty – In the event that the rent is paid late –

  • Enter the date in which the rent must be paid by, to avoid late fees
  • Enter the late fee amount
  • If the check has insufficient funds, enter any additional amount due for insufficient fee processing

Step 9 – The tenant must carefully review the following titled sections of the lease to ensure that they fully understand the responsibilities of both the tenant and landlord as follows:

  • Late Payment Penalty
  • Additional Rent
  • Possession and Use
  • Utilities (Tenant and Landlord responsibilities) Each must check the appropriate boxes for each
  • No Assignment or Subletting
  • Violation, Eviction and Re-Entry
  • Damages
  • Quiet Enjoyment
  • Tenant’s Repairs and Maintenance (Sections A through S)
  • Landlord Repairs
  • Access to Property
  • No Alterations or Installations of Equipment (without prior written permission) – Sections A through D
  • Inspection
  • Insurance
  • Fire and Other Casualty
  • Liability of Landlord and Tenant
  • Pets
  • Notices
  • No Waiver
  • Severability
  • Renewal of Lease (complete the fields within the paragraph)
  • Furniture
  • End of Term
  • Association By-Laws, Rules and Regulations
  • Binding
  • Entire Agreement
  • Attorney Review Clause (Sections 1 through 3)

Step 10 – Broker’s Commission – Complete the following:

  • Check the box indicating who shall be responsible for Broker’s Commission
  • Listing Broker
  • Commission
  • Address and Telephone Number
  • Participating Broker
  • Address and Telephone Number

Step 11 – The tenant must carefully review the following titles sections in order to complete the agreement

  • Lead Based Paint Document Acknowledgement
  • Window Guard Notification
  • Megan’s Law Statement
  • Consumer Information Statement Acknowledgement
  • Declaration of Licensee in Business Relationship(s) – Complete all required fields in this section
  • Acknowledgement of Truth in Renting Statement
  • Smoke Detectors, Carbon Monoxide Alarm and Portable Fire Extinguisher
  • Private Well Testing – (- N.J.S.A. 58:12A-26 to 37)
  • Megan’s Law Registry
  • Other Lease Provisions (if any) Provide witness of tenant and landlord

Step 12 – The final page must remain separate from the rest of the document – Complete the following fields –

  • Date
  • Tenant’s Signature
  • Date
  • Tenant (Print Name)
  • Date
  • Tenant (Signature)
  • Date
  • Tenant (Print Name)
  • Date
  • Owner/Representative (Signature)
  • Date
  • Owner/Representative (Print Name) Dated
