The Real Estate Board of New York Residential Lease Agreement is a standard lease agreement between an owner and tenant for the lease of rental property. The document will outline what is expected by the state of New York from both the tenant and the landlord with regard to all responsibilities pertaining to the rental and care of the property. The tenant should read the document thoroughly. If any of this document is unclear, the tenant may wish to consider consultation with an attorney or take the time to acquire clarification as, understanding by both parties will be reflected upon signature of this document.

How To Write

Step 1 – Download the document and begin by entering the date of completion of this document in mm/dd/yyyy format

  • Enter the owner’s full legal name
  • Owner’s address
  • AND
  • Enter the tenant(s) full legal name(s)
  • Tenant(s) current address

Step 2 – Apartment Use – Provide the following:

  • Enter the apartment letter or number of the combination thereof
  • Enter the floor number of the building where the apartment is located
  • Enter the address of the building
  • Enter the borough and city in the state of New York

Step 3 – Length of Lease –

  • Enter the amount of the rent of the unit
  • Tenant must read and understand the remainder of the paragraph
  • Tenant must read, understand and agree to titled section “Rent Adjustments”

Step 4 – Security Deposit –

  • Landlord must enter the amount of security deposit that must be paid by the tenant to the landlord/owner
  • Owner must enter the name of the bank where the security deposit will be held
  • Enter the address of the bank
  • Tenant must read the remaining paragraphs regarding the security deposit. If the tenant is unclear with regard to any portion of this section, get clarification prior to applying signature in agreement

Step 5 – Titled Sections – The tenant must carefully review all of the titled sections within the remainder of this document as follows:

  • Warranty of Habitability
  • Care of Your Apartment – End of Lease- Moving Out
  • Changes and Alterations to Apartment
  • Your (Tenants) Duty to Obey and Comply With Laws Regulations and Lease Rules (Read A,B and C)

  • Services and Facilities (A through E)
  • Inability to Provide Services
  • Entry to Apartment (A through E)
  • Assigning, Subletting, Abandonment (A and B)
  • Default (1 through 3)
  • Remedies of Owner and Your Liability A through D)
  • Additional Owner Remedies
  • Fees and Expenses
  • Property Loss, Damages or Inconvenience
  • Fire or Casualty
  • Public Taking
  • Subordination Certificate and Acknowledgements

Step 6 – Confirmation of Agreement- Signatures – Provide the following:

Witnesses –

  • Witness’ Signatures

Owner –

  • Signatures of Tenant’s 18 and over

Step 7 – Guaranty- If there is a guarantor for this document, they must read the entire paragraph, understand and agree to it, prior to providing signature(s) – Then enter:

  • Date in mm/dd/yyyy format
  • Signature of Witness
  • Signature of Guarantor
  • Guarantor’s address
  • Apartment
  • Premises
  • Tenant
  • Expiration

Step 8 – Lease Rules – Tenants and Guarantor must read, understand and agree to the rules of this lease

  • On completion some documentation may be required to attach to the documents.
  • Be prepared to provide a Rent Stabilization Lease Rider
  • Window Guard Rider
  • Disclosure of Information on Lead Based Paint and Hazards thereof
  • This form may be required as well, to be attached to the Standard Form of Apartment Lease (AX- 10/82) and the Loft Lease (Copyright 1999)
