The Ohio SubLease Agreement with the written permission of the landlord, is a legal document that is agreed to in writing between an initial tenant and a new tenant.The sublease will allow permission for the subtenant the right to take over the lease or share the lease and the premises that’s already in place, from or with the initial tenant. The subtenant would pay their rent directly to the initial tenant. The initial tenant would then pay the full monthly rental amount to the landlord.

The landlord must continue to hold the initial tenant directly responsible for the rental amount as well as any damages to the premises, including any damages that may have been caused by the subtenant. Usually, the first tenant must get consent from the landlord before he/she is allowed to sublease the premises. The subtenant must carefully review the terms and conditions of the agreement to be certain that they understand their responsibilities, the rules and regulations prior to signing of the lease.

How To Write

Step 1 – Download the document –

  • Enter the name of the Sublessor (initial tenant)
  • Enter the current address of Sublessor  (the initial tenant)
  • Enter the name of the Sublessee (new tenant)
  • Enter the address of the premises as the address of the Sublessee

Step 2 – Sublessor’s Agreement with Sublessee in either the sharing of or overtaking of the premises –

  • Sublessor must enter the address of the premises
  • Enter also the City in the state of Ohio

Step 3 – Term – Check one of the following boxes that will apply to this agreement

  • Fixed Sublease – Enter the starting and ending dates in the fields provided in mm/dd/yyyy format, should this be your selection
  • Month to Month Sublease – Sublessor must enter the beginning date, ending only with a selected amount of days written notice from the Sublessee
  • Week to Week Sublease – Sublessor must enter the beginning date, ending only with a selected amount of days written notice from the Sublessee (usually 30 days notice)

Step 4 – Utilities –

  • Sublessor shall clearly state on the lines provided what utilities the Sublessor shall be responsible for while under agreement

Step 5 – Sublessee must carefully review all titled and completed sections as follows:

  • Liability
  • Security Deposit (Sublessor must enter the amount of the security deposit to be paid upon signing of this sublease) The Sublessee if for any reason finds that  a part of the deposit is withheld, will receive an explanation in writing with in (sublessor must enter the amount of day to expect written explanation)

Step 6 – Titled Sections – Sublessee must read all titled sections in their entirety as follows:

  • Move-in Checklist
  • Master Lease
  • Disputes
  • Other – (Sublessor must enter any other terms and conditions agreed upon by the two parties)
  • Written Agreement
  • Language
  • Minors
  • Original Copies
  • Landlord’s Consent (Landlord must check one of the boxes in this section)
  • Governing Law

Step 7 – Date and Signature -Provide the following:

  • Date the agreement in dd/mm/yyyy format
  • Sublessor’s Signature
  • Printed Name
  • AND
  • Sublessee’s Signature
  • Printed Name
  • Witness’ Signature(s)
  • Printed Name
  • AND
  • If the sublessee is a minor the parent or guardian of said minor must provide:
  • Signature
  • Printed Name
  • AND
  • Landlord’s Consent – provide
  • Signature
  • Printed Name

Attach a the original lease to this document and Inventory Checklist must be attached – The parties must both initial that the attachments have been included
