The Oregon Month to Month Rental Agreement is a legal document whereas a landlord and tenant may agree that the agreement is renewed at the end of each month as long as the rent is paid in a timely manor and the property is cared for. Also providing that the landlord has not sent a notice to vacate. If the lessee decides to leave at the end of the month, then the lessee may do so without breaking the written agreement by providing notice according to State Statute § 91.070 which states that a tenant or landlord may end the lease with notice of 30 days written notice to vacate.

In Oregon this is also called the “At will lease” meaning the renter may remain in the rental unit until either the landlord or tenant should decide otherwise. Month to month rentals are beneficial to all parties as they are flexible in nature for all parties. If the lessee(s) are unsure whether or not they completely understand the language of the agreement, they may consider consultation with an attorney of their choice to clarify.

How To Write

Step 1 – Download the document and enter the following:

  • Landlord’s Name
  • Landlord’s Address

Step 2 – Rental Information – Enter all dollar amounts in the Lines on the right side of the page:

  • Monthly Rent Beginning
  • Pro-Rated Rent
  • Security Deposit
  • Pet Deposit
  • Subtotal
  • Total amount due – security deposit/pet deposit and rent collectively must be paid by cashier’s check only
  • Landlord must specify the maximum amount of occupants that will be allowed in the premises

Step 3 – Lease Term – Landlord must enter the number of months of the lease and the date that the lease will begin

Step 4 – Non Compliance Fee Schedule (per occurrence): The landlord must enter the per occurrence amounts in the fields provided

  • Late charge
  • Insufficient funds check
  • Smoke Alarm/Carbon Monoxide alarm tampering fee
  • Parking violations
  • Failure to clean up pet waste or garbage
  • Unauthorized Pet
  • Late payment of utility to be paid to owner
  • Failure to pay utilities

  • Non-Removal of satellite dish after vacating the premises
  • Lease Buyout Fee/Early termination- 1.5 times the rental amount
  • Tenant(s) must carefully review the “Liability of Tenants” and the “Substitution of Tenants” Sections

Step 5 – Due Date – Tenant(s) must read and agree to sections A through D

  • Tenants must intitial section B
  • Landlord must enter and address whereas the rent may be delivered by drop box and/or any physical address whereas a tenant may take the rent payment
  • In section D the landlord must check the utilities and services that must be implemented prior to move in that will be the responsibility of the tenant
  • Utility Companies – the landlord must provide utility contact numbers

Step 6 – Items furnished – The landlord must check the boxes of the items that will be provided by the landlord for the tenants to use while they occupy the unit

  • Indicate any common utilities
  • Is Recycling available
  • Landlord must indicate how many Unit and PO box key will be provided

Step 7 – Yard Care and Landscaping – Landlord must check the box indicating who will be responsible for the lawn care

  • Tenants must initial in agreement
  • Landlord check whether the sprinkler system is automatic or manual
  • Tenant’s must be responsible for pet waste- read the requirement and initial in agreement
  • Landlord must enter any additional information that the tenant’s should be aware of

Step 8 – Terms and Conditions – Tenant must read all of the terms in this area and provide initials where required in red

Step 9 – Titled Sections – Tenants must read and agree to all titled sections as follows. If there is a statement that requires initials, provide your initials as long as you agree with the statement:
