The South Carolina Association of Realtors Lease Agreement (Form 410) is a legally binding document that is completed, agreed upon and signed by lessor and lessee for the rental of an apartment unit or residential rental property for a stated amount of time (generally 6-12 months). Once the document is signed by all parties, both the lessor will have the right to enforce all aspects of the lease as well, the lessee will have all rights to use the property as state in the document. If at the end of the lease the lessee would like to end the lease, 30 days notice to vacate will be required.

How To Write

Step 1 – Download the document –

  • In the top left side of the page enter the County where the agreement is being completed
  • Enter the address in South Carolina  where the document is being completed
  • Enter the date of completion in dd/mm/yyyy format
  • Enter the name of the tenant(s)

Step 2 – Enter the name of the owner/landlord and check the following box appropriately –

  • Landlord or Tenant is licensed under the SC laws as a Real Estate Licensee

Step 3 – location – Provide the following information:

  • Enter the county in SC where the property is locate
  • Provide the description of the property

Step 3 – Terms – Enter:

  • The date in dd/mm/yyyy considered to be the commencement date of the lease
  • The ending date in dd/mm/yyyy format
  • Read the remainder of the paragraph
  • Read the Lead Based Paint Disclosure
  • Read the “Rental Application” information

Step 4 – Rent – Complete the following within the fields provided

  • Enter the amount of rent that the lessee will pay each month
  • Enter the total rent amount
  • Enter to whom the rent will be payable
  • Read the “Notice to Tenant”
  • Enter the. per day, late fee amount
  • Enter a day of the month that would require additional late fees
  • After (enter day of each month)
  • Enter the daily amount to be paid to landlord if the rent commences or terminates on any other day of the month that the first day of the month

Step 5 – Occupants – Enter the following:

  • Provide the full name of the occupants that will reside in/on the property. (no other occupants will be allowed to reside on the property except those name on the lease without prior written permission from the landlord)
  • Enter the maximum amount of tenants allowed at any time

Step 6  – Returned Checks – Enter:

  • The amount the tenant must pay in the event a rent check was returned insufficient funds

Step 7 – Titled Sections –

  • The tenant’s must read and agree to all titled sections of the contract prior to the provision of signatures, as follows:
  • Renewal Terms
  • Sublease (enter the maximum amount of days that guests may visit the premises, without other written permission)
  • Utilities (landlord must enter any exceptions that the tenant will not be responsible for)
  • Tenant Obligations
  • Maintenance of Premises, Pest Control
  • Essential Services and Appliances (landlord must check all appliances that would be considered part of the rental agreement)
  • Insurance
  • Right to Access
  • Military Clause
  • Definition of 30 day notice
  • Destruction or Damage or Premises
  • Condemnation
  • Absence, Non-Use and Abandonment
  • Security Deposit (landlord must enter the amount of security deposit to be paid by tenant)
  • NonCompliance With Rental Agreement or Failure to Pay Rent
  • Remedy After Termination

  • Pets (landlord must enter the amount of nonrefundable pet deposits and the monthly rental for pets)

Step 7 – Signatures – Tenant(s) must carefully read the statement before application of signature(s)
