The Tennessee Association of Realtors Residential Lease Agreement is a is a legal document or agreement created between a tenant and landlord that will specify rental and security deposit amounts as well as rights, rules, regulations, responsibilities and other laws to be observed. The lease will grant a tenant the right to the exclusive use of the property in exchange for agreed rental payments to the landlord. Additionally, the lease outlines the rights and responsibilities of both the landlord and tenant during the lease term.

How To Write

Step 1 – Tenant Information – Enter the following:

  • Tenant’s Name
  • Landlord’s Name
  • Enter the date of the creation of the agreement in dd/mm/yyyy format

Step 2 – Lease Agreement – Describe the rental property:

  • Address
  • City
  • Zip Code
  • County Register of Deeds Office
  • Located on what page(s) in the deeds book
  • OR
  • Any other instrument number
  • Describe any other portions of the property that would be considered part of the lease
  • Included Items
  • Enter any other items that shall remain with the leased property at no additional cost to the tenant
  • Enter items that will be removed from the property
  • List any third party items or services that will become the responsibility for payment by the tenant
  • If there will be fuel payments, adjustments will be made so that tenant may make monthly payments to landlord or changed into the name of the tenant if possible

Step 3 – Lease Term and Rental Amount – Provide the following:

  • Enter the amount of years and then months, beginning date
  • Enter the same including the ending date
  • Enter the amount of the rent to be paid monthly
  • Enter the address where the rent should be received
  • Enter all other charges appropriately
  • Late charges
  • Additional Charges
  • Enter the Security Deposit amount and to whom it will be paid
  • Enter the address for which the deposit is being paid
  • Enter the name of the financial institution where the funds will be held until the end of the lease

Step 4 – Titled Sections – The remaining sections should be read thoroughly by the tenant prior to submission of signatures:

  • Security Deposit and all sections (A through C)
  • Repairs and Maintenance
  • Lead Based Paint Disclosure
  • Insurance
  • Holdover and Renewal (Landlord will need to enter holdover rental amount terms in this paragraph)
  • Rules and Regulations (Landlord must enter re-key charge amount if any – tenant must read A through M of this section
  • Utilities and Services
  • Fire or Casualty Damage
  • Responsibility of Landlord
  • Sublet and Assignment
  • Default (A through F)
  • Right of Access
  • Abandonment
  • Termination for Violence or Threat to Health Safety or Welfare
  • Notice – Parties must provide contact information one to the other for the purpose of notice or contact
  • Notice to Landlord of Repairs Needed
  • Property Management Company (Landlord must enter management company information, if any)
  • Condemnation
  • Hold Harmless
  • Brokerage
  • Other Provisions (A through G)
  • Method of Execution
