The Texas Association of Realtors Lease Agreement is a legal document that is used only by those who are members of the Texas Association of Realtors. The document will provide complete information regarding expectations between owner/landlord/management and tenant(s) with regard to rental amounts, due dates, security deposits, terms and conditions and more. The landlord must complete the fields within the document and the tenant(s) must read and agree to the information within the document prior to providing signatures.

How To Write

Step 1 – Parties – Enter the following:

  • The landlord’s name
  • AND
  • The Tenant’s name(s)

Step 2 – Property – Provide the property information as follows:

  • Physical Address
  • Legal Description
  • County in which the property is located (include any non-real- property item located on the property)

Step 3 – Term – Landlord must enter:

  • The date of commencement of the agreement in mm/dd/yyyy format
  • The date of expiration of the agreement in mm/dd/yyyy format
  • Tenant(s) must carefully read the remaining “part B” paragraph of the section

Step 4 – Automatic Renewal and Notice of Termination –

  • Tenant(s) must read the entire section
  • If landlord selects option 2, enter an amount of days before the expiration date
  • In paragraph B of this section, the landlord must select either box 1 or 2 and check that box

Step 5 – Rent – Landlord must complete the following fields:

  • Enter the amount of the rent to be paid each month
  • Enter the date that the first full month’s rent is payable
  • Select payment options and check the acceptable boxes

Prorated Rent – 

  • Enter a date in which the prorated amount is due
  • Enter the prorated amount due on or before the entered due date

Place of Payment – 

  • Enter the name of the person/business that the rent is payable to
  • Enter the address where payment is to be made

Method of Payment – 

  • The landlord must carefully read this section and check the preferred boxes

Step 6 – Late Charges – Enter:

  • The date of each month that a landlord must actually receive payment
  • Enter a late fee amount in box a.
  • Enter a percentage of one month’s rent as late fee in box b.
  • Enter any additional late charges that will be paid along with the full late rental payment

Step 7 – Returned Payment (Insufficient Funds) –

  • Enter the amount the tenant(s) will be expected to pay along with any check that has been returned as insufficient

Step 8 – Titled Sections – Tenant(s) must carefully read and agree to all sections of this document as follows:

  • Application of Funds
  • Pets (Enter the amount of rent per day, charged for each unreported and deposited pet)
  • Security Deposit – (landlord must enter the amount of the security deposit to be paid) – select the method in which the deposit is allowed to be paid by checking one of the boxes
  • Utilities – (Tenant(s) are assumed to pay all utilities fees and services – If the landlord will agree to pay any of the utilities or services, enter this information into the lines provided
  • Use and Occupancy – (Enter the names of all occupants)
  • Parking Rules (landlord must enter the maximum number of vehicles allowed to be parked on the property)
  • Access by Landlord
  • Move In condition
  • Move Out Condition
  • Property Maintenance (landlord must select one of the boxes indicating who will be responsible for yard work
  • Repairs (landlord must enter a telephone number for emergencies)
  • Security Devices and Exterior Door Locks
  • Smoke Alarms
  • Liability
  • Holdover
  • Residential Landlord’s Lien
  • Subordination
  • Casualty Loss or Condemnation
  • Special Provisions
  • Default
  • Early Termination
  • Attorney’s Fees
  • Representations
  • Addenda (landlord must review and check all of the appropriate boxes)
  • Notices (Landlord and Tenant(s) must provide an address, email address and fax number for one to the other in order to provide notices)
  • Agreement of Parties
  • Information (in the event of the death of all tenants(s) the landlord must provide all information regarding whom they shall permit to enter the unit to remove property and handle other aspects of termination of the agreement of all decedents) – In section I – landlord must select from one of the boxes with regard to property management. If property management will be in place, provide the name, address, email address and telephone number of the acting manager

Tenants must read and agree to all titles and sections of this document. If tenant(s) are unsure of the language or aren’t certain what they are signing, they may choose to consult with a knowledgeable attorney

Step 9 – Signatures – Provide the following information:

  • Landlord(s) Signature(s)
  • Date Signatures(s)

  • Property Management Signing with Power of Attorney
  • Date of Signature
  • Tenant(s) Signature
  • AND
  • Broker’s Associate’s Printed Name
  • Broker’s Printed Name
