The Virginia Association of Realtors Residential Lease Agreement is a legal document that is created between a landlord and tenant for the purpose of property rental. This document will provide terms and conditions that a tenant must read and agree to prior to allowance to reside on a property. If tenants read the agreement but find that it’s difficult to understand, they may consider a consultation with an attorney before signing the document.

How To Write

Step 1 – Parties – Provide the following information:

  • Date the document in dd/mm/yyyy format
  • Enter the name of the landlord
  • Enter the landlord’s address
  • If there is a broker in charge of the rental, enter the name of the broker and/or the broker’s firm
  • Enter the broker’s address
  • AND
  • Enter the tenant’s name

Step 2 – Summary of Lease Terms – Enter:

  • Address of Dwelling Unit
  • Commencement of date of lease (enter the time of day)
  • Length of the term
  • Lease term expires

Step 3 – Rent – Provide the following:

  • Enter the name of the person the rent payment would be payable to
  • Enter the address where the rent payment is to be delivered

Step 4 – Description of Dwelling Unit

  • Unit type
  • Number of bedrooms
  • Number of bathrooms
  • Year built
  • Appliances and other personal property provided
  • Occupancy (landlord must enter the number of occupancy limit)

Step 5 – Utilities

  • Landlord must enter the utilities that will be included in the rent
  • Enter the utilities that the tenant must obtain
  • Enter any utilities that will be provided by the landlord, but will be charged to tenant separately

Step 6 – Rent – Landlord must enter the following:

  • Monthly Rent
  • Per Diem Rent
  • Prorated Rent (from _______ to _______)
  • Additional Rent
  • Non-Refundable Lease Fee
  • Non-Refundable Pet Fee, if applicable
  • Non-Refundable
  • Unauthorized Pet Fee
  • if applicable Pet Rent if applicable
  • Damage Insurance
  • Actual cost of policy
  • Administrative fee
  • Opt-out fee
  • Renter’s Insurance
  • Actual cost of policy
  • Administrative fee
  • Opt-out fee
  • Total Rent (Rental amounts may be increased pursuant to the terms of this Lease)
  • Late Fee 10% of the total Monthly Rent, or $50.00, whichever is greater

Step 7 – Security Deposit

  • Move-In Security Deposit
  • Pet Deposit
  • Total Security Deposit
  • (Select one) Security Deposit will be held by Landlord OR Agent
  • Landlord must enter the amount of notice prior to cancellation of the lease

Step 8 – Titled Sections – Tenants must read all sections of the document prior to signing as follows:

  • Applicable Virginia Law
  • Security Deposit (A through G)
  • Rent (A through D)
  • Inspection and Condition of Dwelling Unit (A through C)
  • Use, Occupancy and Maintenance (A through L)
  • Utilities (A and B)

  • Landlord’s Inability to Deliver Possession to Tenant
  • Casualty Damage
  • Condemnation
  • Liability of Landlord/Agent

  • Representations in Application for Residential Lease
  • Financial Responsibility
  • Military (A through E)
  • Cancellation; Renewal (A through D)
  • Action by Landlord Upon Default By Tenant (A through G)
  • Unlawful Detainers; Acceptance of Rent with Reservation
  • No Waiver
