The New York small estates affidavit, is used by a spouse or child or other close heir of decedent at least 30 days after the decedent has passed away to collect property of the decedent from third parties who may be holding such property. In order to use this form, there cannot be pending any probate matter. In addition, there must be a certified death certificate included. New York courts also allow you to fill out an online form by answering questions and generating a form. See the program for help in filling-in the statutory form.

How to Write
Step 1 – Write in the name of the decedent.
Step 2 – Check the appropriate box and if applicable the relationship you have to the decedent.
Step 3 – Sign and date in front of a notary public.
